    Special Rules Applied

    Discovery Rule
North Dakota courts allow a discovery rule for latent personal injuries (e.g., toxic exposure), but the statute itself doesn’t expressly provide one. (The discovery doctrine is available through case law in appropriate cases.)

North Dakota has a six-year statute for personal injury claims (one of the longest in the U.S.). The "discovery rule" is not in the statute but has been applied in cases of latent injury or fraud. Tolling: If the claimant is under 18 or mentally disabled when the claim accrues, ND tolls the SOL until majority or restoration of capacity, but not beyond one year after reaching majority and not more than a total of 10 years extension for minors (as minors get until age 19, max). Additionally, ND law caps infancy tolling in professional malpractice at 12 years.

    Frequently Asked Questions

Common questions about North Dakota statutes of limitations

The shortest deadline in North Dakota is 2 years for wrongful death claims, while the longest is 6 years for oral contract disputes. Missing these cut-offs—even by a day—can permanently bar recovery.

Note: North Dakota also enforces statutes of repose, which create an absolute bar after a set number of years, regardless of when the injury is discovered. Our calculator flags these where applicable.

About North Dakota Statutes of Limitations Calculator

A statute of limitations sets the maximum time after an event within which legal proceedings may be initiated. In North Dakota, these time limits vary by the type of claim or offense.

Missing a filing deadline can permanently bar your claim, regardless of its merit. This calculator helps you determine the deadline for your specific case, but always consult with a qualified attorney for legal advice.
